'American Amanda Knox vowed to fight with her head "held high" to prove her innocence after Italian Supreme Court judges ruled Tuesday she should stand trial again for the death of her former roommate in Italy.

Knox spent four years in prison before an appellate court overturned her murder conviction in the 2007 death of Meredith Kercher in Perugia.

Knox, who returned to the United States in 2011 to Seattle was not in court for Tuesday's ruling. Her former boyfriend, Raffaele Sollecito, must also face a new trial over Kercher's death...'

very interesting case, I can't wait to see how this turns out.
It is a remarkable case - and Meredith Kercher's family understandably seek answers to the horrifying event http://www.telegraph.co.uk/news/wor...ter-we-are-still-searching-for-the-truth.html

Current concerns are that since laws regarding murder are different in US where Amanda Knox currently resides, then US might not agree to extradition if she refuses to return to Italy for the re-trial - as is likely for obvious reasons

It would be a violation of her constitutional rights to be extradited in my opinion. In the U.S. you can't try someone a million times till you finally get the verdict you want./ She was acquitted, twice. She won't be extradited. Italy needs some hard evidence on why the U.S. needs to extradite one of its citizens.

QUOTE:

'The decision by the Italian Supreme Court to retry American Amanda Knox for murder will highlight the differences between the two country’s legal systems and test how extradition treaties operate when citizens are convicted of crimes in a foreign country.'

'...25-year-old former exchange student Konx was convicted 2009 of murdering her British roommate, Meredith Kercher, and sentenced to 26 years in prison. Knox served almost four years before verdict was overturned 2011.

“This case will be very valuable for the spotlight it shines on how two countries with very different legal systems will behave in a high-profile case,” says Robert Pugsley, professor Southwestern Law School Los Angeles. He and others say it's unlikely Ms. Knox will go to Italy for trial, but could be tried “in absentia” (without her presence), and the verdict is likely still years away....'

'Most analysts agree US would not extradite Knox if the Italian court sentences her to more time. General rules about extradition among Westernized countries hinge on rights of the accused or convicted person in the country where they are located. US would not extradite Knox if it felt the Italian trial would expose her to "double jeopardy" – a concept that violates the US Constitution Fifth Amendment double jeopardy clause – stating that ‘[no] person be subject for the same offense to be twice put in jeopardy of life or limb,’ ” said Ian Wallach, criminal attorney Los Angeles'

'….The convictions of Knox and her ex-boyfriend, Raffaele Sollecito, were overturned in 2011 for "lack of evidence." After her acquittal, Knox returned to her hometown of Seattle where she has been living since. But Italy's Supreme Court decided last year to retry the case, saying the jury that acquitted Knox didn't consider all the evidence, and that discrepancies in testimony needed to be answered. The retrial's opening day Monday was dominated by procedural items. Presiding judge, Alessandro Nencini, read out the facts of the case, including the conviction of Ivory Coast native Rudy Guede for his role in Kercher's murder.....'

'….The defense teams asked for several items of evidence to be retested for DNA, and Nencini agreed that a knife found in Sollecito's apartment would be re-examined. The court also agreed to hear testimony from Luciano Aviello, who served time in jail with Sollecito and claims that his brother killed Kercher. Also absent from the proceedings Monday was Giuliano Mignini, the Perugia prosecutor who won the original conviction and then lost the appeal....'

'….Patrick Lumumba, the Congolese bartender Knox originally accused of Kercher's murder was in court.

Lumumba spent several weeks in jail after Knox accused him, and he won a defamation suit against her, for which she was ordered to pay €22,000 ($29,800) for his court costs
.

Also in the gallery were Perugia residents who attended the original trials. Court was adjourned until Friday, when Aviello will testify.

A verdict is expected by the end of the year....'

so

WILL DOUBLE JEOPARDY SAVE AMANDA KNOX?

;.....ruling is likely to spark diplomatic tug-of-war between Italy and US for Amanda Knox.
Knox, denies killing Meredith Kercher,
and would rather become a fugitive than return to Italy 'in the hands of people who very clearly want me in prison'.
Knox has attracted huge support from the American public,
but legal experts believe US would be reluctant to reject an extradition request from Italy
- especially as US makes so many requests itself.

Ameria's double jeopardy rule,
under which nobody can be tried twice for the same crime
is explicitly mentioned in the country's extradition treaty with Italy as an example of when the US may not co-operate.....'

'…..However, double jeopardy in US usually covers trials by jury,
and
Knox had been acquitted by appeal court judges.

Italians could use this to argue that her case is not covered by the rule.
US State Department,
which would have to decide whether to forcibly send Knox back to Italy,
has refused to comment.
If United States approves the extradition request
then it is most likely that Knox will then begin a whole separate legal battle within the United States to stay there.
Speaking outside the court, Knox's lawyer, Luciano Ghirga, said she will launch an appeal against the decision....'

'…..The prosecution had asked for Sollecito and Knox to be jailed for 26 years for the murder
and for staging a robbery to cover it up
– as well as for a separate sentence of four years for Knox for a standing slander conviction,
for falsely implicating Congolese bar owner Patrick Lumumba
in statements to police in which she described hearing her room-mate scream

16 February 2012 Publisher HarperCollins announced it signed a deal for an Amanda Knox memoir
which was reportedly worth £2.5 million.
The book, Waiting To Be Heard, was released in April 2013.....'

KNOX AND SOLLECITO BOTH STABBED KERCHER

'…..BRITISH student Meredith Kercher was stabbed by both Amanda Knox and Raffaele Sollecito, Italian judges said,
explaining guilty rulings in the 2007 murder case.
US student Knox and former Italian boyfriend Sollecito
were handed jail terms of 28.5 and 25 years respectively in January,
after case reopened following previous innocent verdicts.
In Italy it is customary for judges to file written explanations
months after their rulings.

Kercher was stabbed in the neck by "two different knives"
- a longer one wielded by Knox, a smaller one by Sollecito -
judges from the Florence Court of Appeal wrote.
Knox dealt the fatal blow, they added......'

The court said Tuesday
http://www.news.com.au/world/breaki...-stabbed-kercher/story-e6frfkui-1226900315290

'…...Knox, Sollecito
and Rudy Guede, Ivory Coast-born small-time drug dealer, tried separately and handed a final guilty ruling carrying a 16-year jail term,
had jointly taken part in murder.

They suggested Kercher was killed following an argument between her and Knox
which got out of hand, and also led to Guede sexually assaulting victim,
keeping her immobilised while the others stabbed her.

Court said Knox and Meredith "did not like each other",
and suggested, on the night she died,
the victim confronted her US flatmate about the "uncivilised conduct" of Guede,
who had been let into the house by Knox.
Police found Guede's unflushed faeces in a toilet.......'

OKay well here is a problem it is not double jeopardy case because the conviction was overturned on appeal not on retrial. that is italian law. Knox will eventually face US judge IF Italian govt will request her extradition. HOWEVER, Kerry MAY send Knox back IF Italy will have something to hand over that US needs like a terrorist or something along those lines. KNox will face US judge without the jury. He/she will weigh everything that has been going on. She was acquitted ONCE on appeal. Because the prosecution has been adding - convict at all cost - contaminate evidence, it is HIGHLY unlikely US will extradite her BUT knowing Kerry, i woulndt be surprised if the US will eventually send her back. so we have to see what happens with everything around terrorism and the US relations with Italy.

Here is a catch if knox leaves the US to an extradition friendly with italy country, she is SKREWED! the US will not be able to pull her out in time. So she has to stay in the US perm. the govt itself is not interested in filing extradition cause if that was the case, then they would not let out out of italy. so eventually this fiasco will die down

UPDATE: http://www.thedailybeast.com/articl...-knox-a-key-decision-approaches-march-25.html

There are several factors that cannot be considered when determining Knox’s legal rights.
With double jeopardy off the table, Knox’s defense could have potentially argued that she was convicted in absentia,
but Canestrini says that because Knox wrote a letter to the appellate court judge, Alessandro Nencini, during the trial
explaining why she wasn’t there, she essentially acknowledged she was on trial.
“Her lawyers should have never let her write that letter, That email, read in court, means there is evidence of her awareness of the trial.” says Canestrini

Canestrini adds that ther issues, like a pregnancy, could also play a role.
Knox would be able to delay extradition three years for every child she might have
based on current American standards for extradition.
“But she would have to have a lot of babies to make that work long-term,” he said.
Canestrini also says Knox’s lawyers could eventually try to negotiate a deal with the Italian justice ministry,
especially if they use the argument that Italian prisons are over-crowded.
Such a deal could include the option that she serve her sentence in the United States
if there is no legal loophole to get her out of being extradited.

Sollecito won’t have so many options.
The Italian authorities have already taken his documents, and no doubt he is under the watchful eye of the local police.
His lawyers might argue that he should not have to serve a sentence unless and until Knox does,
but given the fact that Guede is in prison and equally judged guilty, most legal experts say that wouldn’t work.
On his online resume on his website, in which he lists the many media interviews he has given tied to his murder conviction under “media skills,”
he describes one of his greatest strengths as his “ability to overcome insurmountable obstacles.”

Sollecito has had his travel documents seized

and will appear in court on Wednesday.
He is reportedly seeking to separate his case from Knox's,

with his lawyers pointing out that a partial confession written by the American

and later retracted

did not mention his presence at the scene of the crime.

If that argument succeeds the Italian could be given a new trial.

Meanwhile, Rudy Guede, an Ivory Coast-born drifter sentenced to 16 years for murder in a separate trial,
will qualify for permits to leave jail for a few hours by the end of this year.
His lawyer, Walter Biscotti, told the Times that he could qualify to work outside jail during the day within two years.

Amanda Knox 'relieved' murder conviction overturned by Italian Court

By Ralph Ellis and Hada Messia , CNN
Updated 6:31 PM ET, Fri March 27, 2015

Rome, (CNN)[Breaking news update, posted at 8:24 p.m. ET]
Amanda Knox, whose murder conviction was overturned Friday by Italy's Supreme Court, issued a statement saying she was "relieved and grateful" because of the decision. She thanked family and friends for their support and said, "The knowledge of my innocence has given me strength in the darkest times of this ordeal."

[Previous story, posted at 6:10 p.m. ET]

Italy's Supreme Court has overturned the murder conviction of American Amanda Knox and her former boyfriend in the 2007 slaying of her British roommate, the court announced late Friday.

Knox, 27, of Seattle, was convicted in 2009 for the killing of British student Meredith Kercher, who shared an apartment with her in the Italian university town of Perugia. Knox's boyfriend at the time, Raffaele Sollecito, had been found guilty, too.

The case is now closed, the court said, and both Knox and Sollecito are free to go.

Thus ends an eight-year legal saga that gripped the United States, Britain and Italy.

The semi-naked body of the 21-year-old Kercher, her throat slashed, was found in November 2007 at the home she shared with Knox in Perugia.

Prosecutors in Perugia said Knox directed Sollecito and another man infatuated with her, Rudy Guede, to hold Kercher down as Knox played with a knife before slashing Kercher's throat.

Both Sollecito and Knox were convicted in 2009 and sentenced to lengthy jail terms. Guede, a drifter originally from the Ivory Coast, was tried separately and is serving a 16-year sentence.
Then, after the evidence was re-examined, an appeals court quashed the two students' convictions in October 2011, citing a lack of evidence against them, and both were set free to return to a "normal" life.

Two years later, they were retried and their acquittals overturned. Knox was sentenced in absentia to 28½ years in prison. Her ex-boyfriend got 25 years.

VICTIM MEREDITH KERCHER'S FAMILY RESPONDS TO THE RULING

Meredith Kercher's family say their emotions are "raw" after the ruling,
which ends a highly controversial legal battle.
The family of Ms Kercher have said they were shocked by the ruling, although they knew it was a possibility.
In a statement they said: "Emotions are naturally raw at this stage.
The decision came as a shock but was an outcome we knew was possible, even if it wasn't what we expected.
"We have briefly spoken with our legal representative in Italy,
but we now understand this decision to be definitive and the end of what has been a long and difficult process for all concerned.

"We believe we will learn of the full reasoning behind the decision in the coming months
but for now we need some time to take this in and remember Meredith, the victim at the heart of this."
Ms Kercher, who was 21 and from Coulsdon in Surrey, was sexually assaulted and stabbed to death in Perugia in 2007.

But the legal seesawing now seems to be over after both convictions were annulled by Italy's Supreme Court.

The judges, after 10 hours of deliberation,
concluded that a conviction could not be supported by the evidence.
Their reasoning will be released within 90 days.

'…..Lumumba was arrested November 2007 and spent two weeks behind bars
after Knox told Italian police he had killed 21-year-old Kercher, from Coulsdon, Surrey.

At the time Knox, now 27, told investigators she had “covered her ears as he [Lumumba] killed Kercher"
in the bedroom of the flat the women shared.

Her claim – which Italian prosecutors alleged was to direct suspicion off herself
was later proved to be false and Knox was given a three-year sentence for it.

Knoxhas since said she struggles with guilt over the false accusation.
But Lumumba, who said his life and business were ruined by the allegation
said: “Amanda lied to me. I am feeling very bad [about the acquittal].”......'

'….Congolese bar owner Patrick Lumumba 42
falsely accused by Amanda Knox of killing Meredith Kercher
said decision to quash conviction of Amanda Knox was a triumph for being “American and rich” rather than justice
surprise ruling by Italy’s supreme court to annul murder convictions of Knox and Raffaele Sollecito
was motivated by political and diplomatic reasons.
“This is not good for justice, I think it shows the power available for rich people,
she’s American and rich. For a country like Italy this is not good.
I think there were diplomatic problems with the US
and it makes things difficult with the US
so they let her free.
Amanda is free because she is American,
but Americans are human like everybody.”....'

'....Speaking from Krakow in Poland with his wife after losing his bar in Perugia
and struggling to find a job in the wake of the false murder accusation
Lumumba said that despite the final ruling in the case, he still believed Knox held the answer to the case
.
What Amanda did I don’t know, but I think she knows why Meredith died.”
Kercher’s mother, Arline, said she was “surprised and shocked” at Friday’s ruling
and added it was too early to know what the family would do next.
Before Friday’s verdict it had been widely anticipated that the court would order a retrial
even if it overturned the previous convictions....'

Speaking outside the courtroom on Friday, the family’s lawyer, Francesco Maresca, said:
“The judges said there is a lack of proof and whoever acted with [Rudi] Guede [the only person found guilty of the murder] has not been found.”
Guede, from Ivory Coast, is almost halfway through a 16-year prison sentence after his trial was fast-tracked in 2008.

Amanda Knox Is Asking for Money for a Wedding

but

She’s Already Married

The Seattle native opened a crowdfunding site
to raise $10,000

for a space-themed wedding on Leap Day 2020.

The only problem is she got married in December 2018

Knox told ABC News:
“I did not put it out there expecting to get a dime from anyone,”

despite the fact that
the registry offers 18 options to donate
between $25 and $10,000 for the wedding.

I read in the news about her wedding crowdfunding idea and how she is already married. It caused me to search old articles from here where I was hoping there would be an answer about whether she did it or not. But it seems even the horaries and composites came back with hazy answers.

What I want to know is, did she do it??

I went to considerable lengths doing my own investigation some years back, and I can tell you for certain that hers (& her bf's) testimonies were full of holes and contradictions, plus she lied outright and got an innocent man jailed. My memory of all the specific details is hazy now - but not the overwhelming sense of her I got.... that she is a narcissist/sociopath.

Particularly most interesting, was a video I came across a few years later, in which she was being interviewed. She was giving a full account ..
Her body language, smiling and giggling at inappropriate moments, embroidering too many minor details into it, it was exactly as though she had memorised a script , a story she had told herself in her head over and over.. She came across as completely inauthentic. And that confirmed it for me -classic sociopath.

was a sign of her own guilt

It was only by chance that a Swiss businessman read about the case

Lumumba says Knox nearly ruined his life
