he'll do 2/3 as long as he behaves. And survives.

Derek Chauvin got the basic 12.5 years

and

5 years each for 2 aggregators


one being a cop
and
secondly being it was a slow death.

Judge Cahill didn’t mention the child witnesses
I think certain aggregating factors were negated by mitigating factors.

If he makes it out he will be around 67 years old.
It’s possible that his mom won’t be around by the time he is released.
22 years in a long time.
Will he be able to retire and collect from all the credits he made
working with the police department?
If he’s being released and being able to retire with full benefits
it might be a slap on the wrist

nevertheless

if Chauvin would have just gotten up
none of this would have happened.
guess it felt good to Chauvin to hold Floyd down
as if Floyd was big game he had taken down.
he couldve just lifted his knee
George was a human being with the right to breathe and not die.
Chauvin could have got off of his neck long before he died

and things would have been much better for both of them
Police officers are to protect and serve

not determine justice or law.

It’s almost like he’s slow and lacks brain cells or something!

Anyone else would know
especially with people recording
to get up
the video is pretty damning evidence

that shows Floyd actually died under custody of police restraint
and probably wouldn’t have died
if it wasn’t for police using excessive restraint

His mother's words are very touching.
His chart, if I recall it correctly, is heavy in Pisces, and didn't have violent aspects.
This case has been so manipulated, especially by motivated political groups, that at this point even a retrial perhaps wouldn't be able to give a fair sentence.
I'm still not convinced, without a reasonable doubt as the law requires, of his guilt.
What is clear is that he is now on the Cross and can not get away from it.

Chauvin's mother was there to speak for her son, which is what she did.

Yes, it's too bad we don't have a birth time for him, but the aspects can stil be evaluated, and they do give a lot of info.
All the water, the sun/mars square, no earth/air.

In sentencing Derek Chauvin to 22 1/2 years in prison,

the criminal justice system has shown it can act swiftly and severely
when faced with
a police officer’s slow-motion murder of a Black man
that's recorded by bystanders
and
witnessed by millions.

The question is whether the example made of Chauvin
will change anything for the many Black men and people of color
who are disproportionately killed by police
– often in an instant with inconclusive video and no witnesses.


In Chauvin's case, the public saw a rarity as the levers of the justice system
seemed to move decisively: indictment, conviction, a stiff sentence
a historic civil settlement, plus upcoming trials on federal civil rights charges
and unrelated charges of tax evasion.
Both the state and federal governments are also
conducting civil rights investigations into the Minneapolis Police Department
for a potential history of systemic abuses.


Chauvin murdered George Floyd, 46, in May 2020
after officers responded to a report that he had used a counterfeit $20 bill.
Floyd was handcuffed face-down on the street and repeatedly yelled
"...I can't breathe...." as Chauvin continued to press a knee to his neck
for 9 1/2 minutes.


The egregious nature of Chauvin's crime
has led officers across the country and in his own department
to disavow him and even testify against him. :smile:
Chauvin, 45, has sat in a maximum-security prison
since a jury convicted him on April 20 of second- and third-degree murder
and second-degree manslaughter.

At Friday's sentencing hearing
Chauvin offered his "...condolences..." to the Floyd family
but did not apologize for his actions.
He said he was unable to speak further due to ongoing litigation.

Hennepin County District Judge Peter Cahill
found that Chauvin acted with "...particular cruelty..." toward Floyd
and abused his position of trust and authority as a Minneapolis police officer.
Chauvin will have to register as a predatory offender
and provide a DNA sample.


Under Minnesota law, Chauvin will serve two-thirds of his sentence
or 15 years, behind bars
and the remainder under a type of supervised release
that's similar to parole.
Chauvin will get credit for the time he's already served.
"...If you want to talk real plainly
how do we prevent the creation of the next Derek Chauvin
who is out there wearing a badge carrying a gun
who’s in training, who's thinking about a career in law enforcement
who’s gotten away with abuses unchecked
That's the real task. I’m over Derek Chauvin...."

Holding Chauvin accountable
Chauvin's case has included a series of firsts.
It was Minnesota's first state court trial to be televised in its entirety
primarily due to the pandemic
and garnered national and international interest.
Chauvin's murder of Floyd
was also the first time white people throughout the country
joined in protests with people of color
against police brutality and systemic racism.

And the jury's guilty verdict
was the first time a white police officer was held accountable
for murdering a Black man in Minnesota.
Black men are disproportionately killed by police
which is why legal observers say holding Chauvin accountable
is in and of itself important for Floyd, his family and the community. :smile:

The Floyd family and attorneys Ben Crump, Antonio Romanucci
and Chris Stewart called the sentence a "...significant step forward..."
in a joint statement Friday.
"...This historic sentence brings the Floyd family and our nation
one step closer to healing
by delivering closure and accountability.
For once, a police officer who wrongly took the life of a Black man
was held to account..." :smile:




During the hearing, George Floyd's brother, Terrence Floyd
said he would ask Chauvin
who sat just several feet away from him:

“...Why? What were you thinking?
What was going through your head
when you had your knee on my brother’s neck.
When you knew he posed no threat anymore, yet he was handcuffed.
Why at least didn’t you get up, why did you stay there...?”


Terrence Floyd paused at times with emotion and looked down.
He said he wanted the maximum penalty because
“...we don’t want to see no more slaps on the wrist..."
and noted that if things "...were reversed, there would be no case
it’d be open and shut, we’d be in the jail for murdering somebody.....”
Chauvin showed a "....callous disregard for human life..."
and did so in front of children
who will have to live with the trauma of that experience
said Nekima Levy Armstrong, a civil rights attorney
and former president of the Minneapolis chapter of the NAACP.

She noted that the alleged crime of providing a counterfeit $20 bill
would not have even resulted in jail time. :smile:

But as important as it was to hold Chauvin accountable
legal observers say the unique nature of the case
makes it difficult for it to set any real precedent.
Floyd's death has been influential
in that it has raised national awareness about systemic injustice
and police brutality.

But the recent death of another Black Minneapolis man
Winston Smith Jr., showcases how Floyd's death was an outlier.
He was fatally shot earlier this month by Sheriff's deputies
on a U.S. Marshals task force who claimed he displayed a handgun
in the moments before the shooting
despite a witness statement to the contrary.
There was no bodycam footage.


Chauvin's case was unusual, said Mary Moriarty
the former chief public defender for Hennepin County
who noted that it was
not only tried by the Minnesota Attorney General's Office
with more than a dozen lawyers working pro bono
and "...some of the best expert witnesses I've ever seen..."
but Chauvin has also spent 9 1/2 minutes with his knee on Floyd's neck
in a scene watched by bystanders
and captured on cellphone
and
bodycam video.
"...This is not typical of the cases that usually involve an interaction between a police officer and a black person..."
she said.

"...Those often involve gunshots
and the officer would say he or she was afraid..."
and making a split-second decision
– using language found in Constitutional law and precedent
that has overwhelmingly been favorable to cops.

During Chauvin's trial, the prosecution repeatedly called itself

a ..."pro-police..." prosecution
making a clear distinction between Chauvin
and the rest of law enforcement.
“...The defendant is not on trial for being a police officer
he’s not on trial for who he was
he’s on trial for what he did...”
prosecutor Steve Schleicher told jurors.

Even Friday, at Chauvin’s sentencing hearing
Matthew Frank first thanked Minneapolis police officers
for sticking to their oath and speaking honestly
about their jobs and training during the trial.
“...Being a police officer is a difficult job, we ask a lot of them...
and most police officers do it right...” Frank told the court.


Then he made sure to say again
“...this case wasn’t about police officers...
it was about Derek Chauvin disregarding all that training he received :smile:
and assaulting Mr. Floyd until he suffocated to death....”


Even Judge Cahill
concluding that 270 months was an appropriate sentence for Chauvin
differentiated him from the rest of his department
"...because part of the Minneapolis Police Department's mission
is to give citizens 'voice and respect...'"
he wrote in Friday's sentencing memorandum.
"...Here, Mr. Chauvin, rather than pursuing the MPD mission
treated Mr. Floyd without respect
and denied him the dignity owed to all human beings
and which he certainly would have extended to a friend or neighbor...."

Derek Chauvin will remain in a segregation unit
at a maximum security prison "...for the time being..."
the Minnesota Department of Corrections said Monday.
Chauvin, 45, was sentenced Friday to 22.5 years
in prison for the murder of George Floyd.
He has been held at the Minnesota Correctional Facility
at Oak Park Heights, where he is living apart from the general population
of the prison in the Administrative Control Unit
since a jury found him guilty in April of murdering George Floyd.


Typically after a sentencing hearing in Minnesota
male inmates are brought to the Minnesota Correctional Facility
at St. Cloud, a lower-security facility
where they are booked and assessed.
Their photos and finger prints are taken
and they are given an evaluation
before being sent to a more permanent housing assignment.


A DOC spokesperson said
Chauvin was already being held at Oak Park Heights
before the sentencing hearing
and so would not go through that intake process.
"...He was at Oak Park Heights for his safety pre-sentencing..."
the spokesperson said.
"...Since he was already at Oak Park Heights
and was going to stay there
it would have not made sense to bring him up to St. Cloud..."

Chauvin is among nearly 300 convicted killers at the prison

Oak Park Heights is currently housing 341 inmates
just under 40% of whom identify as white
according to the prison's data.
Of those prisoners, 276 are serving sentences for homicide.
Chauvin was convicted of killing Floyd by kneeling on his neck and back
for more than 9 minutes as he begged for his life.
His sentence of 22.5 years
is higher than the average sentence of 12.5 years
for the average first-time offender charged with the same crime.

A judge found that aggravating factors at the time of Floyd's death
called for the upward departure from sentencing guidelines.
Minnesota inmates must serve a minimum of two-thirds of their sentence
meaning Chauvin could be released in 15 years.:smile:

Judge won't change Derek Chauvin sentencing memo regarding child witnesses :smile:

MINNEAPOLIS
Hennepin County Judge Peter Cahill said Tuesday
he will not amend his sentencing order
for former Minneapolis police officer Derek Chauvin
in regards to children at the scene of George Floyd's murder.

Chauvin was sentenced to 22.5 years in prison last month

for the murder of George Floyd
an upward departure for the state’s sentencing guidelines
for second-degree murder, the most serious
of the charges he was convicted of.
After handing down Chauvin’s sentence
Cahill issued a 22-page sentencing memorandum
explaining his decision, including
why he did not find that the crime happened in front of children
to be an aggravating factor in the case.

Last week, Minnesota Attorney General Keith Ellison
filed a letter with the court
explaining he was unhappy with Cahill's findings
regarding the trauma the four young girls
who witnessed Floyd's murder experienced.
He asked Cahill to revise the memo
to avoid sending the message that
"...the pain these young women endured is not real
or does not matter...."
Cahill denied Ellison's request.
Ellison did not ask Cahill to change Chauvin's sentence.

Chauvin was sentenced to 22 1/2 years in prison in June 2021

A Minnesota court overturned the murder conviction of an ex-cop who killed an Australian woman
— but it's unlikely to affect Derek Chauvin

  • who was convicted of the same crime.
  • Chauvin also had been found guilty of a more severe second-degree murder count.



Wednesday's state Supreme Court ruling
now gives Chauvin an opening
to challenge his third-degree murder conviction in the courts.
BUT
in order to challenge his entire 22 1/2 years sentence
Chauvin would have to successfully overturn the second-degree murder conviction :smile:
which carries the most severe sentence.

Legal experts told the Associated Press that such an appeal would have slim chances of success.


However the ruling may
limit additional charges against Chauvin's police colleagues who were present during Floyd's killing.
Prosecutors accused Thomas Lane, J. Kueng, Tou Thao
of aiding and abetting second-degree murder and manslaughter
and had considered adding a charge of aiding and abetting third-degree murder as well.
Prosecutors are now less likely to add the additional charge
according to the Associated Press.



Lane, Keung, and Thao all pleaded not guilty to the charges against them
and are expected to go to trial in March 2022.

Derek Chauvin, the former Minneapolis police officer
convicted of murder in George Floyd's death
pleaded not guilty Thursday for allegedly violating the civil rights
of a 14-year-old in 2017.

This indictment alleges
that Chauvin deprived the teenager of his right to be free of unreasonable force.
The indictment claims that Chauvin held the teen by his throat
hit him on the head with a flashlight
and then kneeled on his neck and upper back
as the teen was handcuffed and no longer resisting.
The restraint was similar to the one he used on Floyd
and resulted in bodily injury for the teen, according to the indictment.
This teenager, like Floyd, is Black.

had been filed against Chauvin
during his 19-year tenure with the Minneapolis police department

In the Floyd murder trial
prosecutors presented evidence
of Chauvin's history of restraining people by kneeling on their neck

upper back
highlighting eight different incidences to the judge.

In Floyd's death
Chauvin was found guilty of second-degree unintentional murder
third-degree murder
and second-degree manslaughter
for pressing his knee against Floyd's neck for more than nine minutes.

He was sentenced to 22 and-a-half-years in prison.
Judge Peter Cahill rejected Chauvin's request for a new trial in June.
