Brandon Mitchell is Juror 52
one of the 12 jury members who convicted Derek Chauvin
of George Floyd's murder.

The Lawyer You Know reacts to his interview with NBC news.
Did he say the right things
or were his answers something the defense could use
to argue for a mistrial?

Former Minneapolis Police Officer Derek Chauvin
stands convicted of murdering George Floyd
though he has not yet been sentenced.

Chauvin's attorney, Eric Nelson, just filed a motion for a new trial
claiming the judge committed nearly a dozen errors
warranting a new trial.

Here is a review of the claims

contained in the new trial motion
the standard that applies
to resolving such motions
and
why Judge Cahill will deny Chauvin's motion
and proceed to sentencing.

Four ex-police officers indicted
on civil rights charges over George Floyd death

A US federal grand jury has indicted the four former police officers
involved in George Floyd’s arrest and death
accusing them of violating the black man’s constitutional rights
as he was restrained face-down on the road and gasping for air.

The indictment says Derek Chauvin deprived Floyd
of the right to be free from ".....unreasonable seizure
which includes the right
to be free from the use of unreasonable force by a police officer....."

The three-count indictment names:
Derek Chauvin
Thomas Lane
J Kueng
Tou Thao.

Chauvin, Thao and Kueng
are charged with violating Mr Floyd’s right
to be free from unreasonable seizure and excessive force.

All four officers are charged
for failing to provide Mr Floyd with medical care.

Chauvin was also charged in a second indictment
stemming from the arrest and neck restraint
of a 14-year-old boy in 2017.

Lane, Thao and Kueng appeared by videolink
in US District Court in Minneapolis.
Chauvin was not part of the court appearance.
Chauvin was convicted last month on state charges
of murder and manslaughter in Mr Floyd’s death
and is in Minnesota’s only maximum-security prison
as he awaits sentencing.

The other three former officers face a state trial in August
and they are free on bail.
They were allowed to remain free
after Friday’s federal court appearance.

Mr Floyd, 46, died on May 25
after Chauvin pinned him to the ground with a knee on his neck
even as Mr Floyd, who was handcuffed
repeatedly said he could not breathe.
Kueng and Lane helped restrain him

state prosecutors have said Kueng knelt on Mr Floyd’s back
and
Mr Lane held down his legs.

State prosecutors say Thao held back bystanders
and kept them from intervening
during the nine-and-a-half-minute restraint.

Chauvin’s lawyer, Eric Nelson, argued during his murder trial
that Chauvin acted reasonably in the situation
and Mr Floyd died
because of underlying health issues and drug use.
He has filed a request for a new trial
citing many issues
including the judge’s refusal to move the trial due to publicity.

Mr Floyd’s arrest and death
which a bystander captured on video
sparked protests nationwide
and
widespread calls
for an end to police brutality and racial inequality.

According to the indictment

".....the defendants saw George Floyd lying on the ground
in clear need of medical care
and willfully failed to aid Floyd
thereby acting with deliberate indifference
to a substantial risk of harm to Floyd....."

Chauvin was NEVER charged with the incident with the 14 yr old 'boy'...
because the restraint was PERFECTLY LEGAL.
CHAUVIN INDICTED BY FEDERAL GRAND JURY
in a separate indictment

related to an incident

in which he allegedly used unreasonable force

on a Minneapolis 14-year-old
in September 2017
the Justice Department said in a statement Friday.

The first count of that indictment says:

Chauvin
".....held the teenager by the throat
and
struck the teenager multiple times in the head with a flashlight..."

A second count says Chauvin

"....held his knee on the neck and the upper back of the teenager
even after the teenager was lying prone, handcuffed, and unresisting
also resulting in bodily injury....."

:libra: Justice needs to be applied here on the thread where the legal knowledge is even worse than the so-called astrology!

Maybe if you were a cop & underwent training, you would understand the various methods of control/restraint instead of attacking a man for doing his job. Maybe you & :leo::moon: need to do a 'ride along' because cops don't deal with polite, easy-going people. They are often violent, resistant to arrest & will kill a cop if they had the chance.:alien:
They are dealing with the :pluto: criminals and :mars: anger, often turning to gun violence in a matter of seconds.

The mother of the 14-year-old boy said he and his sister had assaulted her. The officers found the teen on the floor on his phone in the rear of the house, and Chauvin ordered him to get up.

in his report on the incident, Chauvin wrote that the teenager “displayed active resistance to efforts to take him into custody,” and noted that, although just 14, the boy was “approximately 6’2″ and at least 240 pounds.”

He conceded that he “deliver (sic) a few strikes to (the teen) to impact his shoulders and hopefully allow control to be obtained.”

The first count of Chauvin indictment says
Chauvin ".....held the teenager by the throat
and struck the teenager multiple times in the head with a flashlight..."
per the DOJ statement.

The indictment, unsealed Friday, says the former Minneapolis police officer
is accused of using unreasonable force against a 14-year-old
on Sept. 4, 2017.
“...Specifically, Defendant Chauvin, without legal justification, held Juvenile by the throat and struck Juvenile 1 multiple times in the head with a flashlight.

This offense included the use of a dangerous weapon

- a flashlight -and resulted in bodily injury to Juvenile 1,”
the indictment says.

Defense lawyers have also argued that all of Chauvin’s earlier use-of-force incidents were deemed within department guidelines.

Hennepin County District Judge Peter Cahill has yet to rule on whether the 2017 video will be allowed at the trial.
The 2017 video was not allowed at the trial
so Jury did not view it
and Jury were unaware of the 2017 incident

nevertheless
Derek Chauvin was found guilty on all three charges
of second-degree unintentional murder
third-degree murder
and
second-degree manslaughter.

immediately Jury verdict was read by Judge
Derek Chauvin was handcuffed, taken into custody
and conveyed to jail where he now awaits sentencing

The Defense lawyer for Chauvin told the Judge that IF they were going to bring up the 2017 incident then the defense were going to bring up G. Floyd's past 'incidents' including violent assault where he & his buddy broke into a home, put a gun to an innocent women's stomach & threatened to shoot her.
Plus, they were going to bring up Floyd's LONG criminal record with illegal drug possession to robbery to the 5 yr prison sentence he rec'd for the brutal attack on a woman in her own home.

The Judge agreed that the defense could bring up Floyd's lengthy criminal past IF the prosecution brought up the incident with the 6 ft 200 lb 14 yr old 'kid' who assaulted. his own mother. S
he called the police & when Chauvin arrived, the large 'kid' was resisting arrest, 'flailing his arms around' & doing everything to avoid being hand-cuffed. If Chauvin had not responded, who knows what the 'kid' have done to his mother.

But I think the lesson for police is to NOT help people anymore who call them in an emergency. Better to leave the victims to their attackers otherwise, the gov't will turn around & charge the police instead of the actual criminal.
:crying::crying::crying:

btw, I don't respond to your Chauvin hate-filled thread because you simply parrot the BLM, fake news without any critical thinking or understanding of the law.

But you decided to use my words to support your attacks against Chauvin and the police & I don't appreciate that.

Hmmmmmmmmmmm.

VERY strange timing. Why didn't they charge Chauvin in 2017 IF they believed he acted inappropriately?:innocent::innocent::innocent:

Wouldn't have anything to do with Chauvin's lawyer filing a motion for a new trial would it?

Nah, I'm sure it's all just a coincidence.:wink::sideways::unsure:

Chauvin's excellent defense lawyer has a very good chance of winning the appeal to have the verdict thrown out & a new trial.

Two days later, the gov't come up with ADDITIONAL charges for Chauvin relating to an incident (which he had been totally cleared of wrong-doing) in 2017.....

AND Federal charges for civil rights.:andy::andy::andy:

The gov't KNOWS Derek Chauvin did not receive a FAIR trial but the violent BLM.Antifa mobs demand his blood & will burn the country down AGAIN if they don't get their way.

Maybe they can charge him with being WHITE. That's a crime now you know.:sad::sad:

Derek Chauvin, the former Minneapolis police officer who was convicted of the murder of George Floyd last month, filed a motion for a new trial on Tuesday.

The motion for a new trial alleges that the court abused its discretion in a number of instances. According to the motion, Chauvin challenges the court’s denial of a request for a change of venue, its denial of an earlier motion for a new trial, its failure to sequester the jury, and the prejudicial mistakes made by the prosecution. The motion also calls for an impeachment of the verdict on the grounds of jury misconduct.

Juror #52 Mitchell LIED on the questionnaire. That alone should be enough for a new trial in addition to the defense witness intimidation (pig's head sent to Chauvin's witness), the mob intimidation, public gov't officials demanding a guilty verdict and conflicting testimony on the cause of Floyd's death.

In the earlier case, Chauvin and another officer responded to a report of a domestic incident on Sept. 4, 2017, the Star-Tribune said.

The mother of the 14-year-old boy said he and his sister had assaulted her. The officers found the teen on the floor on his phone in the rear of the house, and Chauvin ordered him to get up. The boy refused to comply and began 'flailing his arms in the air'.

When the teen didn’t get up, Chauvin allegedly grabbed him, struck him with a flashlight, and pinned him down with his knee for 17 minutes.

The boy complained that he couldn’t breathe.

Defense lawyers have also argued that Chauvin’s earlier incident were deemed within department guidelines.

Brandon Mitchell was a BLM activist on the Jury & LIED to be able to participate in the trial.t

Can you imagine if they found a video of a juror with a 'Free Chauvin' tee-shirt & then LIED about it on the jury questionnaire.

I realize that only WHITE people are guilty with the Lunatic Left, Woke BLM crowd but the LAW is still important in the country.

Don't be childish David. I've always stated that Chauvin is guilty of manslaughter. He should serve some time in prison and be fired from the police force. But the discussion was about the unfair trial & the violent mob rule.

Perhaps if you took time to understand the LAW instead of screaming 'racist murderer cop' you might learn something. Good thing we no longer rely on 'vigilante justice' or you & JupiterAC would have put Chauvin in front of a firing squad without any due process at all.:whistling::whistling::whistling:

Thank you.

It was Chauvin who administered "vigilante justice", in violation of the oath he took when becoming a police officer.

You
appear
to be saying that he should go free because he can't get a fair trial.

Blackbery, I am surprised you are not aware that the *Floyd tragedy was a deliberate smoke and mirrors ploy to incite the public...kinda like a divide and conquer type thing, probably to be used as justification for escalating a police state or as a distraction etc.

— Chauvin had his hand nonchalantly in his pocket and is a strange individual.

— the reason the murder of Floyd became of such huge public interest is because it was captured perfectly for the public to see...

— the public are not stupid yet most are unaware of their psychic abilities...so when they smell something fishy, they get up in arms about it...but miss the real reason...there is a hidden agenda and it has peaked people’s psychic feelers...

This is a good one! Did you think it up yourself? (Not being sarcastic.)

All right, so Chauvin was hired by the Cabal to deliberately cause public anger and strife.

Which means, if they claim that he offed himself, it will mean they've given him a new identity and a very comfortable new life.

At the very least, his serious problems with the IRS should be suddenly cleared up.

Footage of Derek Chauvin, the former Minneapolis police officer facing murder and manslaughter charges in the death of George Floyd, does not show him with his left hand in his pocket as he knelt on Floyd’s neck. Contrary to claims on social media, Chauvin is wearing dark gloves that blend in with the color of his pants.

Former Minneapolis police officer Derek Chauvin wore black gloves and dark pants as he pinned George Floyd to the ground with his knee. As a result, some screen grabs from a bystander’s video of the incident show the color of his gloves blended in with that of his pants.

The screen grabs circulating on social media gave the false impression that Chauvin’s left hand was in his pocket. He was actually holding his knuckles to his thigh.

USA Today enhanced the brightness and exposure of the screen grabs circulating on social media to accentuate the placement of Chauvin’s hand on his thigh.

It is a combination. There is a lady who I think is extremely who runs a horary group on fb (Elena knows which group) and she did mention the name of a philosopher (if you know the name please tell me because I forgot), and he listed like 4 steps to use to get the public to do something that they were initially against. The 4 steps were something like create an event, cause chaos, seek a remedy for the chaos, implement the idea they were originally against as a remedy.

She was the one that also mentioned about the 'hidden hand' secret technique and it got me curious about it.

The public being psychic and them subconsciously being aware of something not being quite right, comes from my conversations with an old Finnish man who was a type of spiritual guru to me for a couple of years, he talked a lot about psychic abilities.

Chauvin being a strange character is maybe an ad hominem but he is, he comes across as hyper anxious and compliant. A lost narc. The perfect candidate to manipulate.
