If that is the case then, the property owners are responsible for accessing the condition of what they are renting out. I suppose they might make a case that the renter should have notified them that the stairs needed repair but, I'm not sure whether they could make the renter liable -- did the renter sign a rental agreement? Might want to check that to see if there are specific references to liability from lack of maintenance.
